Employees' Representation Law

The Employees’ Representation Act regulates the voting rights of employees at the company level. As the representative of employees, the shop steward has voting rights within the firm regarding social, personnel and economic questions. In order to create uniform working conditions, the employer and shop steward may reach agreements that are directly applicable to all employment relationships.

We advise and represent both employers and shop stewards in the exercise of their duties under the Employees’ Representation Act as well as in disputes regarding the scope of their authority under the Act.

Our services include:

  • consultation before, during and after conclusion of industrial agreements, social plans and other agreements;
  • structuring of industrial agreements, social plans and other agreements between management and employees;
  • examination of the scope and content of the individual authority of the parties under the Employees’ Representation Act;
  • representation in resolution proceedings;
  • representation and participation in proceedings before the Labour Relationship Board.
